Power of attorney for a UAE trademark

For foreign owners the power of attorney is the document that most often delays a UAE filing. Prepare it early.

Quick answer

A power of attorney is required whenever an agent files a UAE trademark, and owners based outside the UAE must always use an agent. The power of attorney must be notarised and then legalised for use in the UAE. The UAE is not a party to the Apostille Convention, so an apostille alone is not enough.

Who needs one

The Ministry requires an owner based outside the UAE to “apply through a registration agent with a legal, notarized power of attorney”. A power of attorney is also needed whenever an agent files for a UAE company or resident.

How to prepare it

  1. Your UAE agent sends the wording (usually in English and Arabic).
  2. The owner signs it — for a company, an authorised signatory.
  3. Notarise it in the country of signature.
  4. Legalise it for the UAE: in most countries this goes through the local foreign ministry and the UAE embassy or consulate. The UAE Ministry of Foreign Affairs explains that documents issued abroad are subject to attestation procedures.
  5. Send the original to your agent.

Apostille is not enough

The UAE is not a party to the Hague Apostille Convention, so an apostille certificate does not replace UAE legalisation. (Oman, Bahrain and Saudi Arabia are parties; the UAE, Kuwait and Qatar are not.)

Filing before the original arrives

Agents can often file on a copy so you keep your filing date, and submit the legalised original afterwards within a set period. Ask your agent for the current deadline before you rely on it — a missing original can lose the application.

Questions

Does the UAE accept an apostille for a trademark power of attorney?
No. The UAE is not a party to the Apostille Convention, so the power of attorney must be legalised for the UAE (normally via the UAE embassy or consulate).
Do I need a power of attorney if I live in the UAE?
Not if you file yourself. If an agent files for you, the agent needs a power of attorney.
Can one power of attorney cover several trademarks?
A general power of attorney can usually cover several applications for the same owner. Your agent will confirm the wording.
