How to register a trademark in Kuwait
- Search for earlier identical or similar marks (a preliminary search can be requested from the ministry).
- File one application per class through the ministry's online trademark portal, using the Hawiyati digital ID; foreign applicants file through a local agent.
- The Trademark Office examines the application and issues a decision; formal examination is due within 90 days of filing.
- If accepted, pay the publication fee within 30 days of the acceptance notice and the mark is published.
- Third parties have 60 days from publication to oppose.
- If there is no opposition, pay the registration fee within 30 days after the publication period ends and the registration certificate is issued.
Examination, publication and opposition
- Examination: The Trademark Office examines applications; under the implementing regulations a formal examination decision is due within 90 days of filing, and the applicant then has 90 days to remedy deficiencies.
- Publication: Accepted marks are published electronically by the ministry; refusals and other notices appear in the Official Gazette Kuwait Al-Youm.
- Opposition period: 60 days from publication (not extendable)
Protection, renewal and use
- Term: 10 years from the filing date, renewable.
- Late renewal: 6 months after expiry, with a higher fee (KWD 310 instead of KWD 265)
- Use requirement: a registration can be challenged after 5 years of non-use.
- Rights system: first to file.
Filing from abroad
- Local agent: The ministry's service pages state that a foreign applicant must have a local agent.
- Power of attorney: Power of attorney must be notarised and legalised, with an Arabic translation, and filed with the application.
- Language: Arabic; non-Arabic marks need an Arabic translation and an explanation of pronunciation

Madrid Protocol
Kuwait is not a member of the Madrid System, so an international registration cannot cover it. You need a national filing, usually through a local agent.
