How to register a trademark in Romania

  1. Check earlier marks in the OSIM trademark registry and TMview.
  2. Pay the filing fee and the publication fee, then file the application in Romanian online through the OSIM platform or by post, in person or by email.
  3. OSIM grants a filing date and publishes the application electronically within about 7 days; anyone may submit observations on absolute grounds within 2 months of publication.
  4. Pay the examination fee; OSIM examines the application and must decide within 6 months of publication.
  5. If the application is admitted, the admission is published in the Official Industrial Property Bulletin (BOPI – Trademarks section), opening a 2-month opposition period.
  6. After the registration procedure is complete, pay the registration certificate fee to receive the certificate.

Examination, publication and opposition

  • Examination: OSIM examines the application on its merits and must decide within 6 months of publication of the application, provided the fees are paid. Earlier rights are raised by third parties through opposition.
  • Publication: Applications are published electronically by OSIM; decisions admitting applications are published in the Official Industrial Property Bulletin (BOPI), Trademarks section.
  • Opposition period: 2 months from publication of the decision admitting the application

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after expiry, with a surcharge
  • Use requirement: a registration can be challenged after 5 years of non-use.
  • Rights system: first to file.

Filing from abroad

  • Local agent: Applicants with no domicile, registered seat or effective industrial or commercial establishment in the EU or EEA must be represented by an authorised representative (industrial property attorney), except for the act of filing the application itself.
  • Language: Romanian

Good to know in Romania

  • Opposition comes after OSIM's examination: it runs for 2 months from publication of the decision admitting the application, not from publication of the application.
  • Fees differ for black-and-white and colour marks, and figurative marks pay an extra supplement on examination and renewal.
  • The filing and publication fees must be paid together with the application; otherwise no filing date is granted.
  • Fee amounts are set in euros and converted to lei each year; a new schedule (Order No. 65 of 1 October 2026) applies from 1 January 2027 at slightly higher lei amounts.
  • Romania is an EU member, so a European Union trade mark registered through EUIPO also covers Romania.
