How to register a trademark in Türkiye

  1. Search existing marks with TÜRKPATENT's online trademark search.
  2. File the application through the EPATS electronic system (applicants domiciled abroad must file through a TÜRKPATENT-authorised trademark attorney) and pay the application and class fees.
  3. TÜRKPATENT carries out a formal examination; deficiencies must be remedied within 2 months or the application is deemed withdrawn.
  4. The Office examines absolute grounds for refusal and publishes accepted applications in the monthly Official Trademark Bulletin.
  5. Third parties may oppose within 2 months of publication; refusals can be appealed to TÜRKPATENT within 2 months.
  6. If there is no opposition or it is rejected, the applicant pays the registration fee within the set period and the mark is registered and published in the Bulletin.

Examination, publication and opposition

  • Rights system: first to file.

Filing from abroad

  • Local agent: Applicants domiciled abroad must file through a trademark attorney authorised to practise before TÜRKPATENT (this does not apply to Madrid designations). Foreign nationals may apply under the Paris Convention, the WTO Agreement or reciprocity.

Good to know in Türkiye

  • Registration is a two-stage payment: the registration fee must be paid, with proof submitted, within the set period after the opposition stage or the application is treated as abandoned.
  • Türkiye is party only to the Madrid Protocol, not the Madrid Agreement.
  • If an opponent's mark has been registered for at least five years, the applicant can require proof of genuine use in the five years before the filing or priority date.
  • Final administrative decisions are taken by TÜRKPATENT's Re-Examination and Evaluation Department and can be challenged before the Ankara Intellectual and Industrial Rights Civil Court within 2 months of notification.
  • Official fees are revised annually; the class fee rises from the third class onwards.
