How to register a trademark in Lithuania

  1. Search national, EU and international marks covering Lithuania using the databases linked from the State Patent Bureau website.
  2. File the application in Lithuanian through the State Patent Bureau self-service portal (mano.vpb.lt) or on paper, listing goods and services by Nice class and paying the filing fee.
  3. Foreign applicants without residence or an establishment in the EEA file through a Lithuanian patent attorney.
  4. The State Patent Bureau examines formalities and absolute grounds for refusal; it does not search for earlier conflicting marks on its own initiative.
  5. Accepted applications are published in the Official Bulletin of the State Patent Bureau, after which third parties may oppose within three months.
  6. If no opposition succeeds, the mark is registered and remains valid for 10 years from the filing date.

Examination, publication and opposition

  • Examination: The State Patent Bureau examines formalities and absolute grounds; earlier rights are dealt with only through opposition. The Trademark Law requires a formal examination within one month of receipt; no official overall examination timeframe was found. Urgent examination is available for a fee of EUR 150.
  • Publication: Official Bulletin of the State Patent Bureau
  • Opposition period: 3 months from publication in the Official Bulletin (filed with the State Patent Bureau's Appeals Division)

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after expiry, with a 50% surcharge on the renewal fee
  • Use requirement: a registration can be challenged after 5 years of non-use.
  • Rights system: first to file.

Filing from abroad

  • Local agent: Under Article 11(2) of the Trademark Law, foreign natural persons not permanently resident in Lithuania or another EU/EEA state, and foreign legal persons without an establishment there, must act through a Lithuanian patent attorney.
  • Power of attorney: A power of attorney is required when filing through a patent attorney; a secondary source states a signed copy may be filed within two months of the filing date. Notarisation or legalisation requirements were not found in official sources.
  • Language: Lithuanian (the state language); the online filing portal and forms are available only in Lithuanian
