How to register a trademark in Latvia
- Search the Patent Office trade mark databases for earlier rights, because the Office does not check new applications against existing marks.
- File one mark per application, preferably through the online e-service (Latvija.lv login), listing goods and services by Nice class.
- Pay the application fee (EUR 90 including one class, plus EUR 30 for each additional class) within one month of filing.
- The Patent Office examines formalities and absolute grounds under Sections 6 and 8 of the Trade Mark Law, on average in 2-3 months.
- If the mark is registrable, pay the EUR 95 registration fee within three months; the mark is then registered and published in the Office's official gazette.
- Within three months of publication, holders of earlier rights may file an opposition with the Industrial Property Board of Appeal.
Examination, publication and opposition
- Examination: The Patent Office examines formal requirements and absolute grounds (Sections 6 and 8 of the Trade Mark Law) but does not compare the mark with earlier marks; average examination time is 2-3 months, with a fast track of about 15 working days for eligible applications.
- Publication: Official Gazette of the Patent Office of the Republic of Latvia (published after registration)
- Opposition period: 3 months from official publication of the registered mark (post-registration opposition, filed with the Industrial Property Board of Appeal)
Protection, renewal and use
- Term: 10 years from the filing date, renewable.
- Late renewal: 6 months after expiry with an additional fee of EUR 90; renewal can be filed during the last year of validity
- Use requirement: a registration can be challenged after 5 years of non-use.
- Rights system: first to file.
Filing from abroad
- Local agent: Foreign persons have the same rights as Latvian persons. The Patent Office may require an address for communication in Latvia; the specific rules on mandatory representation are in Chapter XVII of the Law on Industrial Property Institutions and Procedures, which could not be read.
- Power of attorney: When a representative files, the original power of attorney must be submitted (a copy with each application if it covers several); professional patent attorneys may file without one. Documents and signatures generally do not need notarisation or legalisation.
- Language: Latvian; documents in other languages must be filed with a certified Latvian translation
