How to register a trademark in Jersey

  1. Search the Jersey IPO trade mark register for earlier similar marks.
  2. Prepare the list of goods and services using the Nice Classification, including only goods and services the mark is used for or genuinely intended to be used for.
  3. File the application through the Jersey IPO's online portal (myIPO), stating that the mark is in use or that there is a bona fide intention to use it, and pay the fee.
  4. The Jersey IPO examines formalities, classification and absolute grounds; objections must be answered within two months.
  5. If accepted, the application is published in the official journal so third parties can oppose it.
  6. If no opposition is filed or any opposition is resolved, the mark is registered and a certificate is issued.
  7. Renew the registration every 10 years from the filing date.

Examination, publication and opposition

  • Examination: The Jersey IPO examines formalities, classification and absolute grounds. A search for earlier similar marks is carried out for information only and is not a ground for refusal; owners of earlier marks can oppose after publication. No examination timeframe is officially stated.
  • Publication: Published in the Jersey IPO's official journal after acceptance
  • Opposition period: 2 months from publication, extendable by 1 month on request (per a law-firm summary; the period is set by Order under the 2026 Law)
  • Typical timeline: Several months, depending on examination, publication, the opposition period and any issues (Jersey IPO FAQ)

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after the renewal date, with a GBP 60 late-renewal fee
  • Use requirement: a registration can be challenged after 5 years of non-use.

Filing from abroad

  • Local agent: The Jersey IPO states that an IP agent or lawyer is not required to file; any individual or organisation with genuine use or a genuine intention to use the mark may apply. Address-for-service rules for overseas applicants were not confirmed.

Good to know in Jersey

  • Since 1 August 2026 Jersey has its own primary trade mark system: national applications are filed directly with the Jersey IPO and no prior UK registration is needed. The former system of re-registering UK marks in Jersey has ended.
  • From 1 August 2026 Jersey must be designated separately in international (Madrid) applications; a UK designation no longer covers Jersey. International registrations already protected in the UK on that date automatically extend to Jersey.
  • Each application must state that the mark is in use in Jersey or that the applicant has a bona fide intention to use it; false declarations can invalidate the registration.
  • Registrations under the former Trade Marks (Jersey) Law 2000 were moved automatically to the new register and keep their filing and priority dates; marks due for renewal between 1 August 2026 and 1 February 2027 can be renewed at the standard fee until 31 January 2027.
  • EU trade marks do not cover Jersey.
