How to register a trademark in Hungary

  1. Search for earlier marks in HIPO's E-register database and in EU-wide databases; HIPO also offers a paid trademark search service.
  2. File the application with HIPO, preferably through its e-filing system, listing goods and services by Nice class.
  3. Pay the application fee within one month of the filing date, or the application is deemed withdrawn.
  4. HIPO carries out a formal examination and a search for earlier rights, and sends the search report to the applicant.
  5. The application is published in the Gazette of Patents and Trade Marks, opening a three-month opposition period.
  6. HIPO examines the application ex officio on absolute grounds and decides any opposition before registering the mark and issuing a certificate.
  7. Renew the registration every 10 years from the filing date.

Examination, publication and opposition

  • Examination: HIPO examines formalities, prepares a search report on earlier rights, and examines the application ex officio on absolute grounds; relative grounds are raised by opposition. No standard processing time is stated, but accelerated and particularly accelerated procedures can be requested for a fee within one month of filing.
  • Publication: Gazette of Patents and Trade Marks (HIPO's official monthly gazette)
  • Opposition period: 3 months from publication of the application (or of its modification or division)

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after expiry, with a supplementary fee of HUF 40,500
  • Use requirement: a registration can be challenged after 5 years of non-use.
  • Rights system: first to file.

Filing from abroad

  • Local agent: Applicants without residence or seat in the European Economic Area must appoint a representative (patent attorney or attorney-at-law) for proceedings before HIPO.
  • Language: Hungarian; an application may be filed in a foreign language, but the list of goods and services must then be filed in Hungarian within 2 months of the filing date
