How to register a trademark in Estonia

  1. Search the Estonian Patent Office trade mark databases, TMview and other registers for earlier conflicting marks.
  2. Prepare a final list of goods and services by Nice class, because goods and services cannot be added after filing.
  3. File the application in Estonian through the Patent Office e-services portal (or on a paper form) and pay the state fee within 2 months using the reference number issued by the Office.
  4. The Patent Office examines the application in order of arrival; it does not examine conflicts with earlier rights of third parties.
  5. If the mark is accepted, the decision to register is published in the Estonian Trade Mark Gazette.
  6. Within 2 months of that publication, interested parties may file an opposition with the Industrial Property Board of Appeal.
  7. Renew the registration every 10 years, within the 12 months before the term expires.

Examination, publication and opposition

  • Examination: The Estonian Patent Office examines applications in order of arrival; the stated examination queue for national applications is approximately two months (about two weeks under the accelerated procedure). Since 1 April 2019 the Office no longer examines relative grounds (earlier rights), which are left to opposition.
  • Publication: Estonian Trade Mark Gazette (published by the Estonian Patent Office)
  • Opposition period: 2 months from publication of the registration decision notice in the Estonian Trade Mark Gazette; filed with the Industrial Property Board of Appeal

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after expiry, with a restoration fee of EUR 45 in addition to the renewal fee
  • Use requirement: a registration can be challenged after 5 years of non-use.
  • Rights system: first to file.

Filing from abroad

  • Local agent: A person with no residence, seat or commercial/industrial enterprise in Estonia must act through an Estonian patent attorney for Patent Office and Board of Appeal proceedings, except for the act of filing the application itself. E-residents without an Estonian enterprise must also appoint a patent attorney.
  • Power of attorney: Since the 1 April 2019 reform, a power of attorney is no longer required to be filed with the Patent Office.
  • Language: Estonian (national applications are filed in Estonian)

Madrid Protocol

Estonia is a member of the Madrid System (in force since 1998). You can designate it in an international application filed through your home office, or file a national application directly. A local firm can advise which route is cheaper for your classes and timeline.
