How to register a trademark in Croatia

  1. Search earlier trademarks in the Office's databases or TMview before filing.
  2. File a separate application for each sign on Form Ž-1 (or by e-filing), listing goods and services by Nice class, with proof of payment of the application fee.
  3. The Office examines formalities and absolute grounds for refusal; earlier rights are considered only if an opposition is filed.
  4. The application is published in the Croatian Intellectual Property Gazette, opening a three-month opposition period.
  5. If there is no successful opposition, the Office invites the applicant to pay the 10-year maintenance fee, after which the mark is registered.
  6. Renew the registration every 10 years from the filing date.

Examination, publication and opposition

  • Examination: SIPO examines formalities and absolute grounds ex officio; relative grounds are examined only on opposition. The Office states the whole procedure normally takes 9 to 12 months.
  • Publication: Croatian Intellectual Property Gazette (Hrvatski glasnik intelektualnog vlasništva), published biweekly
  • Opposition period: 3 months from publication of the application
  • Typical timeline: 9 to 12 months for the whole procedure, according to SIPO

Protection, renewal and use

  • Term: 10 years from the filing date, renewable.
  • Late renewal: 6 months after expiry, with fees doubled
  • Use requirement: a registration can be challenged after 5 years of non-use.
  • Rights system: first to file.

Filing from abroad

  • Local agent: Persons without permanent residence or registered office in Croatia must appoint a representative (an authorised representative entered in SIPO's register, or an attorney or law firm registered with the Croatian Bar Association), unless an international treaty provides otherwise.
  • Power of attorney: A written power of attorney is required; it can cover specific applications or be a general power of attorney for all present and future matters, which SIPO records in a register. Notarisation or legalisation requirements were not verified.
  • Language: Croatian
