How to register a trademark in Paraguay
- Search existing marks for possible conflicts.
- Instruct a registered Industrial Property Agent and give a notarially certified power of attorney.
- File a separate application for each Nice class with DINAPI, giving an address for service in Asunción.
- DINAPI's Trademark Section checks the application for completeness (formal examination).
- A notice of the application is published for three consecutive days in a newspaper of the capital, opening a 60-business-day opposition period.
- If no opposition is filed, the Trademark Section carries out the substantive examination, including a search of earlier marks.
- DINAPI grants the registration or refuses it by reasoned resolution, or first issues an office action.
Examination, publication and opposition
- Examination: DINAPI's Trademark Section examines formalities before publication and examines substance (including a prior-mark search) only after the opposition period ends without opposition. No official processing time was found.
- Publication: A notice of the application is published for three consecutive days in a major-circulation newspaper of the capital (Decree 22365/1998, Art. 30, as amended by Decree 6.815/2005); renewals are published for one day.
- Opposition period: 60 business days, counted from the business day after the last newspaper publication (Law 1294/1998, Arts. 21 and 46)
Protection, renewal and use
- Term: 10 years, renewable.
- Late renewal: Renewal may be requested in the last year before expiry, or within a 6-month grace period after expiry on payment of a surcharge (Art. 19)
- Use requirement: a registration can be challenged after 5 years of non-use.
- Rights system: first to file.
Filing from abroad
- Local agent: All filings before the office require the intervention of a registered Industrial Property Agent as sponsor or attorney (Art. 117); the applicant or its attorney must give an address in the capital, Asunción, and legal entities may act only through a registered agent (Art. 5).
- Power of attorney: A special or general power of attorney is required when the applicant does not file in person, and it must be recorded in the office's register of powers. Powers granted abroad need only notarial certification, not consular legalisation (Art. 115). An agent authorised by letter, fax or email may act if the formal power is filed within 60 business days (Art. 116).
