How to register a trademark in Colombia
- Optionally order a trademark search (antecedentes marcarios) through the SIC's SIPI system to check for similar earlier marks.
- File the application online through SIPI or in person at the SIC (or a partner Chamber of Commerce outside Bogotá), paying the fee for each class; the filing date sets priority.
- The SIC examines formalities within 15 business days; any defects must be corrected within 60 business days.
- The application is published in the Gaceta de Propiedad Industrial.
- Anyone with a legitimate interest may oppose within 30 business days of publication; the applicant may answer within 30 business days of notification.
- The SIC examines the mark on substance, decides any oppositions and grants or refuses registration; an appeal can be filed within 10 days of notification.
- Once the grant is final, the registration certificate number is assigned; renew every 10 years.
Examination, publication and opposition
- Examination: The SIC examines formalities within 15 business days of filing, then examines registrability on substance (Decision 486, arts. 134–137) after the opposition period and rules on any oppositions in the same decision.
- Publication: Gaceta de Propiedad Industrial (SIC)
- Opposition period: 30 business days from publication in the Gaceta de Propiedad Industrial
Protection, renewal and use
- Term: 10 years from the registration date, renewable.
- Late renewal: 6 months after expiry, with a surcharge (renewal may otherwise be requested in the 6 months before expiry)
- Use requirement: a registration can be challenged after 3 years of non-use.
- Rights system: first to file.
Filing from abroad
- Local agent: The SIC states that a lawyer is not required: individuals may file directly and a legal entity files through its legal representative. The SIC's guidance has no separate rule for foreign applicants.
- Power of attorney: A power of attorney may be a private document and needs no notarisation or legalisation; it can cover specific applications or all present and future ones.
- Language: Spanish; documents in other languages need a simple Spanish translation, and non-Latin characters in a word mark need a transliteration or translation

Good to know in Colombia
- Colombia's trademark law is the Andean Community common regime (Decision 486), shared with Bolivia, Ecuador and Peru.
- Online filing is cheaper than paper filing for every trademark fee, and micro, small and medium-sized enterprises (MiPymes) pay reduced application fees.
- Opposition and substantive examination are decided together: the SIC issues one resolution that grants or refuses the mark and rules on any oppositions.
- The SIC can call a facilitation hearing (audiencia de facilitación) between applicant and opponent, or the parties can jointly request one, before the first-instance decision.
- SIC fees are updated every year; the 2026 schedule took effect on 1 January 2026.
