Good to know in Jordan
- The Trademarks Law is registration-based: no damages claim can be brought for infringement of an unregistered mark (art. 33(1)), although owners of well-known marks have specific remedies.
- Registration is dated from the filing date, and the 10-year term runs from that date.
- A mark can be cancelled for non-use if it has not been used for three continuous years before the cancellation request, unless there are justifiable reasons; use by an authorised licensee counts.
- The 2008 amendments added provisions on international registrations under the Madrid system, but Jordan does not appear on WIPO's list of Madrid Protocol members, so protection requires a national filing.
- The Ministry offers online trademark search by number, name and owner, and Jordanian marks are also searchable through TMView.
