Good to know in Iraq

  • Since 2011 the Kurdistan Regional Government has run its own trademark registration in Erbil; brand owners active in the Kurdistan Region often register there as well as in Baghdad.
  • Since April 2024, filing and publication fees are reportedly payable at filing, and applications covering class 5 (pharmaceutical, veterinary and medical preparations) must include a certified copy of the home registration certificate legalised by an Iraqi consulate.
  • Under Article 21 as amended, a cancellation petition may be filed if the mark has gone unused for an uninterrupted period of three years, unless there is a lawful excuse.
  • Registration is prima facie evidence of ownership, and ownership can no longer be contested after five consecutive years of use, except under the cancellation rules of Article 21 (Article 3 as amended).
  • Customs cannot act on their own initiative; counterfeit goods can be stopped at the border only on the basis of a court order.
