How to register a trademark in Algeria
- Applicants domiciled abroad appoint a representative in Algeria and give them a dated and signed power of attorney.
- Create an account on the INAPI website, start a new trademark filing online, and print the filing form and payment slip.
- Pay the filing and publication fees and file three signed copies of the form, with the payment receipts and power of attorney, at INAPI in Algiers or a regional annex.
- INAPI checks formalities; deficiencies must be corrected within two months, extendable once by two months.
- INAPI examines the mark against the refusal grounds of the Ordinance; the applicant has two months (extendable by two) to answer any objection.
- If no ground for refusal applies, the mark is registered, a certificate is issued and the registration is published in INAPI's official bulletin of marks.
Examination, publication and opposition
- Examination: INAPI examines formalities and then checks the refusal grounds in Article 7 of Ordinance 03-06, which include conflicts with earlier rights (the decree provides for consent from the earlier right holder). No official examination time is stated.
- Publication: INAPI's official bulletin of marks (registrations, renewals and other recorded acts are published after registration)
Protection, renewal and use
- Term: 10 years from the filing date, renewable.
- Late renewal: 6 months after expiry (renewal can also be filed in the 6 months before expiry); INAPI's fee page lists a late renewal surcharge
- Use requirement: a registration can be challenged after 3 years of non-use.
- Rights system: first to file.
Filing from abroad
- Local agent: Applicants domiciled abroad must be represented before INAPI by an appointed representative, unless a reciprocity agreement provides otherwise (Ordinance 03-06, art. 13; Decree 05-277, art. 6).
- Power of attorney: A dated and signed power of attorney naming the representative is required; INAPI asks for the original. No notarisation or legalisation requirement is stated in the decree.

Good to know in Algeria
- The law contains no pre-registration opposition procedure; earlier right holders must seek cancellation of a registered mark through the courts, within five years of registration unless it was obtained in bad faith.
- A renewal request must include evidence that the mark was used in the year before expiry, and renewal may not change the mark or extend the goods and services.
- A registration can be revoked if the mark has not been used for three uninterrupted years, shorter than the five years common elsewhere.
- The Ordinance makes marking compulsory for goods and services offered or sold in Algeria and prohibits using a mark in Algeria that is neither registered nor applied for.
- A Paris Convention priority claim must be made at filing, with the certified priority document filed within three months.
