Quick answer
Trademarks in Myanmar are registered with the Intellectual Property Department, Ministry of Commerce (IPD); third parties can oppose within 60 days from the publication date. A registration lasts 10 years from the filing date and can be renewed. Myanmar is not in the Madrid System, so a national filing is needed.

How to register a trademark in Myanmar
- Appoint a Myanmar trademark representative by filing a notarised Appointment of Representative form with the IP Department.
- File the application with the Intellectual Property Department through its online filing system.
- The IP Department examines the application.

Filing from abroad
- Local agent: Secondary sources state that owners act through a Myanmar trademark representative, appointed by a notarised Appointment of Representative form filed with the IP Department.
- Power of attorney: A notarised Appointment of Representative form (distinct from a traditional power of attorney) must be filed with the IP Department (secondary source).

Madrid Protocol
Myanmar is not a member of the Madrid System, so an international registration cannot cover it. You need a national filing, usually through a local agent.

Good to know in Myanmar
- The Trademark Law 2019 took full effect on 26 April 2023, replacing the old practice of recording ownership declarations with the Office of Registration of Deeds; old recordals give no rights unless the mark was re-filed under the new law.
- Marks re-filed under the new law keep a seniority right based on prior use for five years from the filing date (the 'transitional period').
- The IP Department issued its first registration certificates on 1 December 2024.
- A registered mark not used for three continuous years may become vulnerable to cancellation.
- Myanmar is not a member of the Madrid Protocol, so protection requires a national filing; WIPO Lex also lists no Paris Convention or Nice membership (its WIPO-administered treaty is the WIPO Convention, since 2001), and it is bound by TRIPS as a WTO member.
