How to register a trademark in Hong Kong

  1. Search the IPD Public Online Search and Image Mark Finder for earlier conflicting marks, optionally using the IPD preliminary advice service (Form T1).
  2. File Form T2 online through IPD e-filing or by post or in person at the Trade Marks Registry in Wanchai, listing goods and services by Nice class.
  3. The Registry checks the filing for deficiencies, which must be remedied within 2 months of notice.
  4. The Registry examines the mark on absolute and relative grounds; objections must be overcome within 6 months (extendable by 3 months).
  5. Accepted marks are published in the Hong Kong Intellectual Property Journal.
  6. Third parties may oppose within 3 months from publication.
  7. If there is no opposition, or it fails, the mark is registered and a certificate of registration is issued.

Examination, publication and opposition

  • Examination: The Trade Marks Registry examines applications for formalities and on absolute and relative grounds; IPD states the whole process can take as little as 6 months if there are no deficiencies or objections.
  • Publication: Hong Kong Intellectual Property Journal
  • Opposition period: 3 months beginning on the date of publication
  • Typical timeline: As little as 6 months from filing to registration if there are no deficiencies, objections or opposition (IPD).

  • Late renewal: 6 months after expiry with a HK$500 late renewal charge; restoration possible afterwards for a higher fee
  • Use requirement: a registration can be challenged after 3 years of non-use.
  • Rights system: first to file.

Good to know in Hong Kong

  • Hong Kong has a separate trade mark system from Mainland China; a Chinese (CNIPA) registration does not cover Hong Kong and vice versa.
  • The Madrid Protocol does not yet apply to Hong Kong: the Trade Marks (Amendment) Ordinance 2020 provides the legal basis, but no commencement date had been announced as of early 2026.
  • Defensive trade mark registrations are available for well-known marks at a separate fee.
  • A series of marks can be filed in one application for the same fee as a single mark.
  • Payment by credit card is only available through the IPD e-filing system.
