## Steps
1. Decide whether to file with the Trademark Office in Sana'a, the office in Aden, or both, since they operate separately.
2. Run a clearance search of the register (the Aden office performs a mandatory clearance search before filing).
3. File the application with the Trademark Office, claiming Paris Convention priority within six months if available.
4. The Registrar examines the application for registrability.
5. Accepted applications are published, and any interested party may oppose within 90 days of publication.
6. If there is no opposition or it is rejected, the mark is registered and a certificate is issued.

- **Examination:** The Registrar (Director General of the intellectual property department) examines applications; no official time frame found.
- **Publication:** Official Trade Gazette (Al-Tijarah), per secondary sources; the law refers to publication by a widely circulated method set in the Executive Regulations
- **Opposition:** 90 days from publication; the applicant must reply within 30 days of notice of the opposition
- **Late renewal:** Renewal may be filed within one year after the end of the term; otherwise the mark is removed from the register
- **Power of attorney:** Not set by the law. A practitioner country guide reports that the power of attorney must be legalised by a Yemeni consulate or another Arab consulate, together with a certified extract of the applicant's commercial register; one set of documents can serve several applications.
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Two trademark offices operate in practice: Sana'a and Aden. The Aden office has worked independently since February 2018, covers much of southern Yemen including the main port, and has removed marks that were maintained only in Sana'a. Separate filings and renewals in both offices are widely recommended for nationwide protection.
- Both offices apply the same law (Law No. 23 of 2010); there is no formal legal split, only separate administrations.
- Yemen is not a Madrid Protocol member, so protection requires national filings; Yemen has been party to the Paris Convention since 15 February 2007.
- Marks for Class 33 goods and alcoholic beverages in Class 32 cannot be registered.
- A registered mark can be cancelled by a court if not used for five consecutive years without valid reasons; after cancellation for non-renewal, the mark cannot be registered by others for three years.

## FAQ

### How long is the trademark opposition period in Yemen?
90 days from publication of the application.

### How long does a trademark registration last in Yemen?
Ten years from filing, renewable for further ten-year periods; renewal may still be filed within one year after the term ends.
