## Steps
1. Search the IPO trade mark database for identical or similar earlier marks.
2. File the application online or by post with the IPO, listing the goods and services under the relevant Nice classes and giving an address for service in the UK, Gibraltar or the Channel Islands.
3. The IPO examines the application and checks for the same or similar earlier marks, raising any issues in an examination report.
4. Once accepted, the application is published in the Trade Marks Journal.
5. Third parties have two months from publication to oppose, extendable to three months by filing a notice of threatened opposition (TM7A).
6. If there is no opposition, or an opposition fails, the mark is entered on the register.

- **Examination:** The IPO examines the application and searches for the same or similar earlier marks; no official examination time is stated, but GOV.UK says registration usually takes around 3 to 4 months if there are no issues.
- **Publication:** Trade Marks Journal (published online by the IPO)
- **Opposition:** 2 months from publication in the Trade Marks Journal, extendable to 3 months by filing Form TM7A (notice of threatened opposition) within the first 2 months
- **Timeline:** Around 3 to 4 months from application if there are no objections or oppositions (GOV.UK)
- **Late renewal:** Renewal is possible up to 6 months after expiry with a late renewal fee; after that a removed registration may be restored on Form TM13 (fee £125)
- **Language:** English
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Since the UK left the EU, EU trade marks no longer cover the UK; protection must come from a UK national application or a Madrid designation of the UK.
- Official fees rose by an average of about 25% from 1 April 2026 (the online application fee went from £170 to £205).
- The IPO does not refuse applications on the basis of earlier marks on its own initiative; owners of earlier marks are left to oppose, so watching the Trade Marks Journal matters.
- Filing a TM7A notice of threatened opposition is free and gives an extra month to decide whether to oppose.
- Jersey and Guernsey keep their own trade mark registers, separate from the UK register.
