## Steps
1. Search the OEPM trademark database for earlier conflicting signs before filing.
2. File the application through the OEPM electronic office (sede electrónica), in Spanish, and pay the application fee for each class.
3. OEPM checks formal requirements and, if there are no defects or they are corrected, publishes the application in the Official Industrial Property Gazette (BOPI).
4. Third parties with earlier rights may file oppositions or observations within two months of publication.
5. OEPM examines the application for statutory prohibitions and any oppositions, notifying the applicant of objections so it can respond.
6. OEPM grants or refuses the mark and publishes the decision in the BOPI; the decision can be appealed within one month of publication.

- **Examination:** OEPM carries out a formal examination before publication and a substantive review after the two-month opposition period; no official processing time is stated on OEPM's procedure page.
- **Publication:** Boletín Oficial de la Propiedad Industrial (BOPI), the Official Industrial Property Gazette
- **Opposition:** 2 months from publication of the application in the BOPI
- **Late renewal:** 6 months after expiry, with a surcharge of 25% in the first 3 months and 50% in the following 3 months
- **Language:** Spanish (castellano); in autonomous communities with another co-official language, documents may also be drafted in that language. A foreign priority document in another language needs a Spanish translation.
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Filing electronically through the OEPM e-Office is cheaper than filing on paper (EUR 127.88 versus EUR 150.45 for the first class from 1 April 2026).
- OEPM publishes the application before substantive review, so third parties can oppose or submit observations within two months of BOPI publication.
- In an opposition based on an earlier registered mark, the applicant can ask the opponent to prove use of the earlier mark.
- Spanish registrations run for 10 years from the filing date, and late renewal is possible for six months with a 25% or 50% surcharge.
- Spain is an EU member state, so an EU trade mark from EUIPO also covers Spain; OEPM also handles conversions of EU trade marks into Spanish national marks.
