## Steps
1. Search existing marks, for example in SIPO's trademark databases, before filing.
2. File an application with SIPO online or on form SIPO Z-1 by post or in person, with the list of goods/services classified under the Nice Classification and proof of payment of the application fee.
3. SIPO examines formalities and then absolute grounds for refusal under Articles 42 and 43 of the Industrial Property Act; it does not search for earlier conflicting marks.
4. If the sign is acceptable, the application is published in SIPO's Industrial Property Bulletin.
5. Holders of earlier rights may file an opposition within three months of publication.
6. If there is no opposition or it is rejected, the applicant is invited to pay the registration fee, after which SIPO issues a registration decision and publishes the registration in the Bulletin.

- **Examination:** SIPO examines formalities and absolute grounds for refusal only; relative grounds (earlier rights) are considered only if an opposition is filed. No official examination timeframe is published on the service pages.
- **Publication:** SIPO Industrial Property Bulletin (Bilten za industrijsko lastnino)
- **Opposition:** 3 months from publication of the application in the Industrial Property Bulletin
- **Power of attorney:** A power of attorney must be filed when an agent files the application; notarisation or legalisation requirements are not stated on the official service page.
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- SIPO does not examine conflicts with earlier marks on its own initiative; owners of earlier rights must watch the Industrial Property Bulletin and oppose within three months.
- The basic application and registration fees each cover up to three classes, with small surcharges for each further class.
- Registration is a two-fee process: an application fee on filing and a separate registration fee (covering the first 10 years) payable after the opposition stage.
- Filing through SIPO's e-filing system reduces the application fee by 20%.
- Slovenia is an EU member state, so an EU trade mark from EUIPO also covers Slovenia; national oppositions can also be filed against EU trade mark applications through EUIPO.
