## Steps
1. Run a clearance search, for example in TMview and the INPI online services, before filing.
2. File the application with INPI, preferably online, listing goods and services by Nice class and paying the application fee.
3. INPI publishes the application in the Boletim da Propriedade Industrial, usually within about two weeks of filing.
4. Third parties have 2 months from publication to file an opposition (reclamação), extendable by 1 month; the applicant then has 2 months to reply, also extendable by 1 month.
5. INPI examines the application on absolute grounds and also checks earlier rights on its own initiative, even if no opposition is filed.
6. INPI grants or refuses the application and publishes the decision in the Boletim da Propriedade Industrial.

- **Examination:** INPI examines absolute grounds and also examines earlier rights ex officio, even without an opposition. Practitioners report examination is usually completed 2–3 months after the opposition reply deadline.
- **Publication:** Boletim da Propriedade Industrial (Industrial Property Bulletin), published online by INPI
- **Opposition:** 2 months from publication of the application, extendable by 1 month
- **Timeline:** About 4–5 months if there are no objections; about 8–9 months if opposed (practitioner estimate)
- **Late renewal:** Renewal falls in the last 6 months of the term; a further 6-month grace period is available with a 50% surcharge. After cancellation is published, revalidation is possible within 1 year at three times the renewal fee.
- **Power of attorney:** No power of attorney is needed when an Official Industrial Property Agent files the application.
- **Language:** Portuguese
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- INPI checks earlier conflicting rights on its own initiative, not only when a third party opposes, which differs from many other EU offices.
- Unregistered marks can serve as relative grounds for refusal against a later application.
- Use before registration is not required, and divisional requests are allowed.
- After cancellation for non-renewal is published, the registration can be revalidated within one year at three times the renewal fee.
- Portugal is an EU member, so a European Union trade mark registered through EUIPO also covers Portugal.
