## Steps
1. Search the UPRP e-Wyszukiwarka database and TMview for earlier conflicting marks.
2. File the application with UPRP, preferably electronically, listing goods and services by Nice class and paying the application fee.
3. UPRP carries out a formal examination and an examination of absolute grounds for refusal.
4. The application is published in the Biuletyn Urzędu Patentowego (BUP), opening a 3-month opposition period.
5. If an opposition is filed, the parties have a 2-month cooling-off period for amicable settlement, extendable to 6 months on joint request.
6. After the decision to grant, pay the protection fee for the first 10-year period and the publication fee.
7. The right is entered in the register and announced in the Wiadomości Urzędu Patentowego (WUP).

- **Examination:** UPRP examines formalities and absolute grounds for refusal only; relative grounds (earlier rights) are raised by third parties through opposition. No statutory deadline for examination is set.
- **Publication:** Biuletyn Urzędu Patentowego (BUP) for applications; grants and renewals are announced in Wiadomości Urzędu Patentowego (WUP).
- **Opposition:** 3 months from publication of the application in the BUP
- **Timeline:** About 7–8 months if unopposed; about 12–14 months if opposed (practitioner estimate, not an official figure)
- **Late renewal:** 6 months after expiry, with the renewal fee increased by 30%; this deadline cannot be restored
- **Power of attorney:** A written power of attorney signed by the applicant's authorised persons, filed with the first action through the representative together with proof of the signatories' authority; notarisation or legalisation is not described as required.
- **Language:** Polish; documents in other languages must be filed with a Polish translation
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Renewal requires no separate application: paying the renewal fee with the trademark number and purpose stated renews the right, and UPRP records it without issuing a decision.
- Payment for renewal is accepted from one year before expiry; you can renew for only some of the classes.
- UPRP may partly waive the application fee (by up to 80%) on a documented request showing the applicant cannot pay.
- Poland is an EU member, so a European Union trade mark registered through EUIPO also covers Poland.
- UPRP sends a renewal reminder six months before expiry, but not receiving it does not excuse a missed deadline.
