## Steps
1. Search existing marks for possible conflicts.
2. Instruct a registered Industrial Property Agent and give a notarially certified power of attorney.
3. File a separate application for each Nice class with DINAPI, giving an address for service in Asunción.
4. DINAPI's Trademark Section checks the application for completeness (formal examination).
5. A notice of the application is published for three consecutive days in a newspaper of the capital, opening a 60-business-day opposition period.
6. If no opposition is filed, the Trademark Section carries out the substantive examination, including a search of earlier marks.
7. DINAPI grants the registration or refuses it by reasoned resolution, or first issues an office action.

- **Examination:** DINAPI's Trademark Section examines formalities before publication and examines substance (including a prior-mark search) only after the opposition period ends without opposition. No official processing time was found.
- **Publication:** A notice of the application is published for three consecutive days in a major-circulation newspaper of the capital (Decree 22365/1998, Art. 30, as amended by Decree 6.815/2005); renewals are published for one day.
- **Opposition:** 60 business days, counted from the business day after the last newspaper publication (Law 1294/1998, Arts. 21 and 46)
- **Late renewal:** Renewal may be requested in the last year before expiry, or within a 6-month grace period after expiry on payment of a surcharge (Art. 19)
- **Power of attorney:** A special or general power of attorney is required when the applicant does not file in person, and it must be recorded in the office's register of powers. Powers granted abroad need only notarial certification, not consular legalisation (Art. 115). An agent authorised by letter, fax or email may act if the formal power is filed within 60 business days (Art. 116).
- **Language:** Spanish
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Each application covers a single class: goods or services in several classes need separate applications (Law 1294/1998, Art. 7).
- Applications are published in newspapers: the notice runs for three consecutive days in a newspaper of the capital, and renewal applications are published for one day.
- Substantive examination takes place only after the opposition period has ended without opposition.
- Every filing must be made through a registered Industrial Property Agent; foreign powers of attorney need notarial certification but not consular legalisation.
- Paraguay is not a Madrid Protocol member, so protection requires a national application with DINAPI.
