## Steps
1. Search existing Malaysian registrations and applications for conflicting marks.
2. File the application with MyIPO online or manually, choosing goods/services from the pre-approved list or drafting your own specification; one application may cover several classes.
3. Foreign applicants without a principal place of business in Malaysia file through a registered Malaysian trademark agent.
4. The Registrar examines the application, including a search for conflicting earlier marks, and may issue a provisional refusal that the applicant can answer.
5. Accepted applications are published in the Intellectual Property Official Journal, opening a two-month opposition period.
6. If there is no opposition, or it fails, the mark is registered and a notification of registration is issued.

- **Examination:** The Registrar of Trademarks examines formalities, registrability and conflicts with earlier marks; a provisional refusal may be issued under section 24 of the Act. No official processing time was found.
- **Publication:** Intellectual Property Official Journal published by the Registrar
- **Opposition:** 2 months from publication of acceptance; the Registrar may extend by up to 2 further months
- **Late renewal:** Renewal may be requested up to 6 months after expiry with a surcharge; a removed mark may then be restored within a further 6 months
- **Language:** Malay (the national language) or English; marks containing words not in Roman characters, Malay or English need a translation and, where needed, a transliteration
- **Use requirement:** a registration can be challenged after 3 years of non-use.

## Good to know
- Under section 36 of the Trademarks Act 2019 the filing date is treated as the registration date, so the 10-year term runs from filing.
- Applicants who choose goods/services from MyIPO's pre-approved list pay a lower per-class filing fee than those who draft their own specification (secondary sources report RM950 versus RM1,100 per class).
- A temporary RM300 per-class filing-fee reduction applied from 1 September 2025 to 31 December 2025 for applicants with annual sales turnover below RM500,000 (Trademarks (Reduction of Fee) Regulations 2025).
- A registered mark can be revoked if it is not used in good faith in Malaysia within three years after notification of registration, or if use is suspended for an uninterrupted three-year period.
- Series of up to six similar marks may be filed in a single application, with an additional fee per extra mark.
