## Steps
1. Search the Caribbean Netherlands trademark register (CaribIE) for earlier identical or similar marks.
2. File online through Caribie Filing (recommended) or with a paper form, in Dutch or English, giving the applicant, the mark, and the goods and services.
3. Pay the fee with the application; if payment arrives later, the filing date moves to the payment date.
4. BOIP checks the formal requirements, assigns the goods and services to Nice classes and may ask for more details.
5. If all requirements are met, the mark is entered in the register with the filing date as registration date, and the registration is published.
6. Renew every 10 years, from six months before expiry.

- **Examination:** BOIP checks formal requirements and classification; its procedure page does not describe examination on absolute grounds, and the Act leaves invalidity on absolute grounds to the courts.
- **Publication:** Registrations are published after entry in the CaribIE register
- **Late renewal:** Renewal from 6 months before expiry; late renewal up to 6 months after expiry with a USD 166 surcharge
- **Language:** Dutch or English (Implementing Decree on Trademarks BES, art. 2)
- **Use requirement:** a registration can be challenged after 5 years of non-use.

## Good to know
- Bonaire, Sint Eustatius and Saba have their own trademark register under the Trademarks Act BES; a Benelux trademark is not presented by BOIP as covering the islands, and a Caribbean Netherlands registration is always valid for all three islands.
- The register is run by BOIP on behalf of the Rijksdienst Caribisch Nederland through the CaribIE website, and fees are charged in US dollars.
- The Act provides no opposition procedure: the mark is registered after a formal check, and third parties challenge it through nullity actions in court.
- Rights go to the first filing, and the right lapses after five uninterrupted years of non-use on the islands without due cause.
- The Madrid Protocol applies to the Caribbean part of the Netherlands as a separate territorial entity with its own individual fee (WIPO information notice No. 29/2010, effective 30 December 2010), and a CaribIE registration can serve as the basis for an international application.
